1. Data Controller and Data Protection Officer

Job For Migration, as identified at the beginning of this Privacy Policy, is the Data Controller of all personal data processed in the context of using the services offered by Job For Migration through the Site.

2. Personal Data Subject to Processing

After browsing the Site and in connection with activities related to the Services purchased from Job For Migration by you and/or the company you represent or act for (hereinafter, the “Client”), we inform you that Job For Migration will process your personal data, which may consist – also depending on your decisions on how to use the Services – of an identifier such as your first and last name, email address, an identification number such as a customer code, an online identifier, or one or more elements characteristic of your physical, physiological, mental, economic, cultural, or social identity capable of identifying or making you identifiable (hereinafter “Personal Data”).

We will collect your Personal Data that you voluntarily provide to us (for example, when you contact us for more information about our Services or when creating an account on behalf of the Client to purchase a Service).

The Personal Data processed in the context of using the services offered by Job For Migration through the Site are as follows:

a. Name, contact details, payment details, and other Personal Data

In various sections of the Site, to provide our Services, you will be asked to enter:

To create the Employer Account:
An email address, name, phone number, and the Client’s registered office address.

Within the user profile:
Email address, first, and last name of the user.

When participating in surveys or any promotions made available through the Site, as well as when communicating with Job For Migration through the contact details found on the Site, Job For Migration may also collect additional information about you that you choose to provide to us.

Please note that payment for the Services is made via a third-party platform (depending on the country where you are located, Stripe, Paypal, or others), which operates as an independent data controller and does not allow us to access your payment information, such as credit card numbers or other data that you must provide to complete the purchase.

However, we will use your billing data, which will be requested at the time of purchase, for all tax and accounting obligations and to send you the invoice related to your purchase.

b. Data voluntarily provided by the data subject

In some parts of the Site, you are allowed to communicate various types of information to Job For Migration, which may include Personal Data of others.

After creating an employer account, you can also add users to your team by sending an email invitation.

Regarding Publications on the Site, please note that Job For Migration will, as much as possible, delete any Personal Data relating to third parties before publication – other than the Client (e.g., the hiring manager of your company). However, there is a risk that third parties who view the Posting you have published may track the information contained therein to your identity or that of others, by combining the information with other data in their possession.

Job For Migration, therefore, reserves the right to modify or preemptively remove the Posting (if already published) in the event it considers, at its sole discretion, that such Posting contains personal data or to comply with a request from the person in question whose personal data is present in the Posting.

In any case, with regard to the voluntary provision of Personal Data of third parties, you are the independent data controller, assuming all obligations and responsibilities provided by law. In this regard, you provide Job For Migration with the broadest possible indemnification regarding any dispute, claim, or request for compensation for damages caused by processing, etc., that Job For Migration may face from third parties whose Personal Data has been processed through your use of the Site’s functions in violation of applicable regulations on Personal Data protection. In any case, if you provide or otherwise process Personal Data of third parties in your use of the Site, you guarantee from now on – assuming all related responsibility.

c. Browsing data

The computer systems and software procedures used to operate the Site acquire, during their normal operation, some Personal Data, the transmission of which is implicit in the use of internet communication protocols. This information is not collected to be associated with identified subjects, but by its very nature, through processing and association with data held by third parties, it could allow users to be identified. This category of data includes IP addresses or domain names of computers used by users connecting to the Site, URI (Uniform Resource Identifier) of the requested resources, the time of the request, the method used to submit the request to the server, the size of the file obtained in the response, the numerical code indicating the status of the server’s response (successful, error, etc.), and other parameters related to the operating system and the user’s computing environment. These data are used only to obtain anonymous statistical information about the use of the Site and to ensure its proper operation, identify anomalies and/or abuses, and are deleted immediately after processing. The data may be used to determine liability in the event of alleged computer crimes against the Site or third parties: except for this possibility, web contact data do not currently persist beyond the time strictly necessary for the purposes described above.

  • To provide Services such as: i) enabling you to register as an Employer to access the Client’s personal area, where you can benefit from post-contractual assistance, purchase additional Services, or manage Posts already purchased and/or published by one of the members of your team; ii) verifying your identity and helping you in case you lose or forget your login/password data for your account on the Site; iii) enabling you to view and manage your purchase data, to view the expiration date of the Posts you paid for; (v) enabling you to contact Job For Migration to obtain, by providing your Personal Data in the relevant contact form, additional information about products, services, and specific initiatives of Job For Migration, as well as download information and documents provided by Job For Migration (such as white papers, brochures, etc.) (“Provision of Service”);
  • To send you marketing communications, promotions and advertising, surveys, and market research, via email, SMS, phone, banners, regular mail, instant messages, through an operator, through official Job For Migration social media pages, as well as marketing activities broadly, including prize competitions, games, and contests, relating to products and/or services related to Job For Migration or promoted by Job For Migration (“Marketing”);
  • To send you marketing communications via email related to products and services similar to those you have purchased through the Site (“Soft Opt-In”);
  • To comply with legal obligations that require Job For Migration to collect and/or process certain types of Personal Data (“Compliance”);

4. Legal basis and mandatory or optional nature of processing

The legal bases used by Job For Migration to process your Personal Data, in accordance with the purposes indicated in Paragraph 3 above, are as follows:

Provision of Service: Processing for this purpose is necessary for the provision of the Services and, therefore, for the performance of the contract with you or the Client on whose behalf you act and represent. It is not mandatory to provide your Personal Data to Job For Migration for this purpose, but if you do not provide such data to Job For Migration, we may not be able to provide the relevant Service (including contacting Job For Migration to request additional information about specific products, Services, and initiatives, or downloading information and documents made available by Job For Migration).

Marketing: Processing for this purpose is based on your consent, to be expressed by ticking the specific checkbox in the relevant form. It is not mandatory to give your consent to Job For Migration for this purpose, as it does not affect the provision of Services to you by Job For Migration, and you are free to withdraw it at any time without any consequence, except that you will no longer receive marketing communications from Job For Migration. You can withdraw your consent given previously by following the instructions provided in Paragraph 9 of this Policy.

Soft Opt-In: Processing for this purpose is based on Job For Migration’s interest in sending you marketing communications via email (to the email address you provided in connection with a previous purchase) about Job For Migration’s products and services similar to those you have already purchased through the Site, which represents legitimate processing under the applicable personal data protection laws, and does not require your consent. You can stop receiving these communications at any time by using the link at the bottom of each of these emails, without any consequence to you, other than the fact that you will no longer receive such communications from Job For Migration.

Compliance: Processing for this purpose is necessary for Job For Migration to comply with any legal obligations. When you provide Personal Data to Job For Migration, it must be processed in accordance with applicable law, which may involve its storage and communication to authorities for accounting, tax, or other obligations.

Abuse/Fraud/Litigation: The information collected for this purpose will be used solely to prevent and/or detect any fraudulent activity or abuse in the use of the Site and, consequently, to enable Job For Migration to defend itself in court, handle claims, disputes, and/or pre-litigation matters.

 

5. Submitting your job application to Job For Migration

Job For Migration also offers users the opportunity to submit their job application via email to work at Job For Migration through the “Work with us” section of the Site. In this case, Job For Migration will collect and use the information provided by the User solely for the purpose of selection and application management. The legal basis for the collection and processing of Personal Data in applications is the execution of pre-contractual measures adopted at the User’s request. In any case, the User is advised not to include any sensitive Personal Data and/or special categories of Personal Data (such as health information, political opinions, sexual life, etc.) in their resume and/or the relevant form, unless strictly required by law for the purpose of selecting and evaluating the resume and application (such as belonging to protected categories). If the User accidentally provides Job For Migration with such data, which are not necessary for evaluating the application, Job For Migration will not consider them.

Job For Migration will retain the personal data of Users who have submitted their job applications for positions at Job For Migration for 6 months from the submission of the data, in case the candidate does not establish an employment/collaboration relationship with Job For Migration.

 

6. Recipients of personal data

Your Personal Data may be shared with the parties listed below (the “Recipients”):

  • Individuals who typically act as data processors, namely: i) individuals, companies, or professional firms that provide assistance and advice to Job For Migration on accounting, administrative, legal, tax, financial, and debt collection matters related to the provision of Services; ii) individuals with whom it is necessary to interact for the provision of Services (e.g., hosting providers or email platform service providers); iii) individuals responsible for performing technical maintenance activities (including network equipment and electronic communication network maintenance);
  • Individuals authorized by Job For Migration to process the Personal Data necessary to perform activities strictly related to the provision of Services, who are committed to confidentiality or have an appropriate legal obligation of confidentiality (e.g., Job For Migration employees);
  • Job For Migration Group companies for internal administrative purposes;
  • Subjects, entities, or authorities to whom it is mandatory to disclose your Personal Data for purposes of Compliance, Abuse, or Fraud, or by order of authorities.

 

7. Transfer of Personal Data

Given Job For Migration’s international presence, some of your Personal Data is shared with Recipients who may be located outside the Brazilian and Canadian Economic Area.

The transfers are subject to adequate safeguards, such as adequacy decisions, Standard Contractual Clauses, or other safeguards. 8. Retention of Personal Data

Personal Data processed for the purposes of Service Provision will be retained by Job For Migration for the time strictly necessary for that purpose. In any case, since such Personal Data is processed to provide the Services to you, Job For Migration may retain it for a longer period, particularly as necessary to protect Job For Migration’s interests from potential claims, disputes, or pre-litigation related to the Services.

Personal Data processed for Marketing purposes will be retained by Job For Migration until you withdraw your consent. Once your consent is withdrawn, Job For Migration will cease using your Personal Data for this purpose but may, however, retain it to the extent necessary to protect Job For Migration’s interests from potential claims based on such processing. Please note that withdrawing consent does not affect the lawfulness of processing based on consent before its withdrawal.

Personal Data processed for Soft Opt-In purposes will be retained by Job For Migration until you object to such processing through the link at the bottom of each Soft Opt-In email or by writing to dpo@jobformigration.com.

Personal Data processed for Compliance purposes will be retained by Job For Migration for the period required by specific legal obligations or applicable law.

Personal Data processed for the prevention of Abuse/Fraud/Disputes will be retained by Job For Migration for the time strictly necessary for the aforementioned purpose and, therefore, until Job For Migration is required to retain it to defend itself in court, in litigation and/or pre-litigation, and to communicate such data to the competent Authorities.

 

9. Data Subject Rights

You have the right to request from Job For Migration, at any time:

  • access to your Personal Data, or a copy of such Personal Data, as well as further information regarding the ongoing processing of such Personal Data;
  • the rectification or updating of your Personal Data processed by Job For Migration, if it is incomplete or outdated;
  • the deletion of your Personal Data from Job For Migration’s databases;
